Subd cmte acts on complaint of condo unit owners


THE City Council committee on subdivision and landed estate chaired by Councilor Edgar S. Cabanlas discussed the complaint of several unit owners of a certain condominium located in Barangay Lapasan.

The unit owners are complaining about the cutting of water supply to their respective condo units for their non-payment of association dues, which imposition they are protesting for violation of the Master Deed of Declaration of Restriction (MDDR).

During the meeting, one of the unit owners said their water supply has been disconnected even if they have paid their water bills.

The unit owners also alleged that the fitness gym and other facilities have been in full operation contrary to IATF guidelines of not more than 50-percent capacity.

According to Engr. Ernest Gabuya, area manager of the condominium project, the management served several notices of disconnection to unit owners who are delinquent in the payment of association dues. Out of 34 delinquent unit owners, only 15 settled their dues, he said.

Gabuya said the management even allowed unit owners to partially pay their association dues arrears and waived the penalties.

However, one of the unit owners said he already paid his water bills that is a separate issue from the monthly association/condominium dues.

For his part, a representative of the Department of Human Settlement and Urban Development (DHSUD-10) said issues on the imposition and collection of dues can only be resolved before the Securities and Exchange Commission (SEC), while issues on health protocols will be endorsed to the Department of Health (DOH) for appropriate action.

The representative of the company assured the committee that if the 19 unit owners will settle partially their bills, water supply will immediately be restored with waived penalties.

As this developed, Councilor Cabanlas requested the two parties to have a dialogue to settle the complaint.

He also appealed for the reconnection of the water supply in the condominium while the city is under MECQ.
