SP approves Deed of Usufruct with Barangay Macabalan
The 20th City Council, in its regular session Monday presided over by Vice Mayor Bebot Rodriguez, enacted an ordinance authorizing City Mayor Rolando A. Uy to enter and sign the Deed of Usufruct with the Local Government of Barangay Macabalan (Usufructuary), covering the use of the City-owned property (open space), with an area of 685 sq.m as site of the proposed barangay Super Health Center.
The term of the usufruct is 25 years and renewable upon agreement of the parties.
The agreement prohibits Barangay Macabalan from directly or indirectly assigning or transferring its right of usufruct over the subject property or any portion under any circumstance, and will render null and void the contract in case of violation of its terms by the barangay. It is also required to preserve the peaceful possession and non-proliferation of illegal or informal settlers within the vicinity of the subject property during the effectivity of the contract. It shall also construct and maintain infrastructures, facilities, structures, and improvements in accordance with existing city ordinances and national laws on environmental safety, structural integrity, maintenance, and preservation, among others.
For its part, the city shall not be responsible or liable for delays in the performance of obligations of the usufructuary when caused by, related to, or arising out of acts of God, quarantines, weather, national, regional, or local disasters, calamities, or catastrophes, inability to obtain materials (or reasonable substitute therefor), among others.
The legislation was certified urgent by the City Mayor and unanimously approved by the members of the City Council.
