RESOLUTION NO. 14195-2022

RESOLUTION PRESCRIBING THE INTERNAL RULES OF PROCEDURE (IRP) OF

THE 20TH CITY COUNCIL (SANGGUNIANG PANLUNGSOD) OF CAGAYAN DE ORO TO GOVERN THE CONDUCT OF ITS BUSINESS)

​​​​WHEREAS, Section 50 of Republic Act. No. 7160, otherwise known as the Local Government Code of 1991, provides that on the first regular session following the election of its members and within ninety (90) days thereafter, the City Council (Sangguniang Panlungsod) shall adopt or update its existing rules of procedure;

WHEREAS, during the deliberation of the provisions of the draft IRP, the members of both majority bloc and minority bloc had a consensus to forthwith create an Ad Hoc Committee to further discuss certain provisions thereof that were objected to or proposed to be amended by some members of the minority bloc;

WHEREFORE, on motion by Councilor Edgar S. Cabanlas, duly seconded by Councilor Roger G. Abaday, be it

 

RESOLVED, to prescribe the Internal Rules of Procedure (IRP) of the 20th City Council (Sangguniang Panlungsod) of Cagayan de Oro to govern the conduct of its business, to wit

RULE I

TITLE

SECTION 1.  TITLE. - This Resolution shall be known as the 20th City Council (Sangguniang Panlungsod) House Rules.

RULE II

MEMBERS AND COMPOSITION

SECTION 2. COMPOSITION. – The City Council (Sangguniang Panlungsod) of the City of Cagayan de Oro shall be composed of the City Vice-Mayor as Presiding Officer, the regular Sanggunian Members, the President of the City Chapter of the Liga ng mga Barangay, and the President of the Panlungsod na Pederasyon ng mga Sangguniang Kabataan, as members.

SECTION 3. OFFICERS. - For the smooth, orderly and efficient floor deliberations, the City Council (Sangguniang Panlungsod) shall have the following officers:

 

a) Presiding Officer​

b) Presiding Officer Protempore​

c) Majority Floor Leader​

d) Assistant Majority Floor Leader​

e) Minority Floor Leader​

f) Assistant Minority Floor Leader

RULE III

PRESIDING OFFICER

SECTION 4. THE PRESIDING OFFICER. – The City Vice-Mayor shall be the regular Presiding Officer of the City Council (Sangguniang Panlungsod).

SECTION 5. POWERS AND DUTIES:

a) Preside at all sessions of the City Council (Sangguniang Panlungsod);

b) Call sessions to order;

c) Verify if quorum is present and, in the absence of a quorum, adopt such measures that would ensure the attendance of the absent members;

d) Announce from time to time the business in the Order it is to be acted upon by the legislative body;

e) Vote on any measure only to break a tie;

f) Recognize any member who is recommended for recognition for the floor by the Majority Floor Leader;

g) State all questions and motions presented before the legislative body and when necessary, put the issue(s) to a vote and announce the results thereafter;

h) Decide all questions of order, subject to the appeal to the legislative body as a whole;

i) Maintain order and proper decorum during sessions and, in case of disturbance or disorder within the premises of the session hall, adopt appropriate measures and call peace officers, as may be needed to restore and preserve order in the session;

j) Sign all ordinances, motions and resolutions officially enacted, approved and passed by the legislative body within ten (10) days from the passage of ordinances enacted and resolutions adopted by the City Council (Sangguniang Panlungsod) in the session over which she presided;

k) Sign and whenever necessary, authenticate all orders, acts, memoranda and other purposes of the legislative body;

l) To decide all questions of order subject to appeal by any member, who may explain his/her appeal in not more than five minutes and which appeal shall not be debatable nor to an explanation of vote in case of nominal voting;

m) To prepare and submit to the Executive Department the annual budget of the Sanggunian with the assistance of the Committee on Finance, Ways and Means & Appropriations;

n) Perform such other duties and functions and exercise such other powers as may be given to her from time to time, by the legislative body.

RULE IV

PRESIDING OFFICER

SECTION 6. PRESIDING OFFICER PROTEMPORE. - The body shall elect from among the members a Presiding Officer Protempore who shall preside over the session whenever for any reason, the City Vice Mayor is unable to attend the session, or chooses to actively participate in the floor deliberation thereof, or when the City Vice Mayor is traveling within the country but outside his/her area of jurisdiction for a period not exceeding three (3) consecutive days. 

       He/she shall certify within ten (10) days from the passage of ordinances enacted and resolutions adopted by the City Council (Sangguniang Panlungsod) in the session over which he/she temporarily presided.

RULE V

MAJORITY FLOOR LEADER; DUTIES AND POWERS

SECTION 7. THE MAJORITY FLOOR LEADER. – From the members of the majority party or the coalition of members composing the majority, there shall be elected by a majority vote of the members of the Sangguniang Panlungsod a Majority Floor Leader. He/she shall:

a) Automatically chairs the Committee on Laws and Rules;

b) Recommend to the Presiding Officer any member of the legislative body who wants recognition on the floor for discussion or deliberation by the body except the preferred motions as provided for hereof;

c) Act as Ex-Officio Member of all standing committees of the Sanggunian where he/she is neither the Chairperson, Vice-Chairperson or regular member thereof;

d) Perform such other duties and functions as the legislative body may assign to him/her or authorize him/her to do.

RULE VI

ASSISTANT MAJORITY FLOOR LEADER; DUTIES AND POWERS

SECTION 8. ASSISTANT MAJORITY FLOOR LEADER. - There shall be an Assistant Majority Floor Leader who shall:

(a) Assume the duties, responsibilities and functions of the Majority Floor Leader in the latter’s absence or incapacity;

(b) Assist the majority floor leader in facilitating the speedy transaction of the business of the legislative body; and

(c) Perform such other duties and functions as the legislative body may assign to him/her.

RULE VII

MINORITY FLOOR LEADER; DUTIES AND POWERS

SECTION 9. MINORITY FLOOR LEADER. - There shall be a Minority Floor Leader who shall be elected from the members of the minority party, subject to confirmation by the Body, who shall lead his group during the deliberations of the said matter(s) in every session of the legislative body.

SECTION 10. ASSISTANT MINORITY FLOOR LEADER. - There shall be an Assistant Minority Floor Leader who shall assume the duties, responsibilities and functions of the Minority Floor Leader in the latter’s absence or incapacity.

RULE VIII

SANGGUNIAN SECRETARY; MACE

SECTION 11. SANGGUNIAN SECRETARY. – The Secretary of the Sangguniang Panlungsod shall record the proceedings of the sessions of the body, authenticates the same, and issues certified copies thereof; and shall exercise such powers and functions as prescribed by law and ordinance.

 

SECTION 12. POWERS AND DUTIES OF THE SECRETARY:

 

​(a) Attend meetings of the Sanggunian Panlungsod and keep the minutes of the proceedings.

(b) Record in a book kept for the purpose, and in a consecutive sequence the corresponding reference numbers of all proposed ordinances and resolutions for enactment or adoption by the Sanggunian including the respective dates of their receipt, passage, enactment and/or adoption and subsequent publication, as the case maybe.

(c) Forward ordinances and resolutions enacted or adopted by the Sanggunian to the City Mayor for appropriate action, which have been certified/attested as such by the Presiding Officer, within ten (10) days after the same has/have been signed by the Presiding Officer or Presiding Office Protempore, as the case maybe.

(d) Keep and affix the seal of the Sanggunian on all ordinances and resolutions signed and approved by the City Mayor.

 

(e) Attest all ordinances and resolutions approved by the Sanggunian and signed by the City Mayor.

 

(f) Translate into Cebuano, as the case maybe, all ordinances and resolutions immediately with the original, posted at the main entrance of the city hall, published in a local newspaper and disseminate to all barangays through their barangay captains.

 

(g) Furnish certified copies of all records and documents in his charge not otherwise classified upon payment to the city treasurer of the corresponding fees prescribed by ordinances.

 

(h) Keep his office and all records therein which are not confidential in nature, open to the public during usual business hours.

 

(i) He shall officially receive and record in consecutive manner the dates and time of receipt, all proposed resolutions and ordinances, communications, committee reports, messages and other documents endorsed and addressed to the Sanggunian Panlungsod for proper action and immediately thereafter, report them during the next session for the information and appropriate action of the legislative body.

 

(j) Exercise such other powers and perform such other duties and functions as may be prescribed by law or ordinances, or by the Vice Mayor or as authorized by the majority of all members of the City Council (Sangguniang Panlungsod).

 

SECTION 23THE MACE. –  The Mace shall be the symbol of the authority of the Sanggunian and shall be displayed at the presiding officer’s rostrum when the Sanggunian is in session.

 

The mace shall serve as the warrant for the Sergeant-at-Arms in enforcing order in the Sanggunian.

RULE IX

STANDING COMMITTEES

SECTION 13. STANDING COMMITTEES. - At its annual organizational session, the following regular committees whose general areas of responsibility and jurisdiction as indicated herein, shall be constituted by the legislative body.

1.) Committee on Agriculture – It shall study, investigate and report on all matters or proposed ordinances or resolutions related to agriculture, food production and agri-business, agricultural economic research, soil survey and conservation; agricultural education and extension services; animal industry and livestock quarantine, farm credits as well as matters dealing on farmer relation to landowner and program on comprehensive agrarian reform.

2) Committee on Barangay Affairs – It shall study, investigate and report on all matters involving the affairs of all the barangays in the city, review of the barangay budget, ordinances and resolutions and oversee the proper implementation and compliance of all national issuances involving barangay governance. This also includes the supervision of the delivery of the basic services, aids and financial assistance for the barangay programs and projects.​

 

3) Committee on Climate Change Adaptation and Mitigation and Disaster Risk Reduction - shall have general jurisdiction over all matters pertaining to:

(a) Mainstreaming of climate change, in synergy with disaster risk reduction, into the sectoral and local development plans and programs;

 

(b) Formulation of a Framework Strategy on Climate Change to serve as the basis for a program for climate change planning, research and development, extension, and monitoring of activities on climate change;

 

(c) Recommending legislation, policies, strategies, programs on and appropriations for climate change adaptation and mitigation and other related activities;

 

(d) Creation of an enabling environment that shall promote broader multi-stakeholder participation and integrate climate change mitigation and adaptation;

(e) Facilitation of capacity building for local adaptation planning;

 

(f)Implementation and monitoring of climate change initiatives in vulnerable communities and areas;

 

(g) Overseeing the dissemination of information on climate change, local vulnerabilities and risks, relevant laws and protocols and adaptation and mitigation measures;

 

(h) Coordination with local government units (LGUs) and private entities to address vulnerability to climate change impacts;

 

(i) Creation of policy options and strategies on multi-hazard disaster risk reduction and mitigation;

 

(j) Addressing of issues on cooperation mechanisms for disaster risk management;

 

(k) Addressing of issues on multi-hazard assessment, preparedness, early warning and response to disaster risks.

4) Committee on Cooperative Development - It shall study, investigate and report directly and principally relating to cooperative movements and organizations, financing assistance programs, incentives and matters that promote cooperative development to urban and rural areas including livelihood programs.

5) Committee Economic Enterprises – It shall study, investigate and report on all matters and measures relating to the establishment, maintenance and operation of all income-generating entities of the City Government such as the public markets, abattoirs, bus terminal and all sub-terminals.

6) Committee on Education - It shall study, investigate and report on all matters and measures, including proposed ordinances or resolutions concerning education, the establishment, maintenance and operation of schools, colleges and universities; libraries and museums; non-formal and community adult education.

7) Committee on Environment - It shall study, investigate and report on all matters or proposed ordinances or resolutions dealing on sanitation, ecology and natural resources; environmental protection, exploration, development, utilization and conservation of natural resources, including flora and fauna; and the preservation, protection, prevention and the development of the city’s river systems and Macabalan Bay.

8) Committee on Ethics and Blue Ribbon - It shall study, investigate and report to the City Council (Sangguniang Panlungsod), in aid of legislation, its findings and recommendations on cases involving graft and corruption, irregular or anomalous transactions, unethical or other immoral conduct, other violations or infractions of lawful regulations committed by any official or employee of the City,  Government, or in connivance with any private individual upon verified complaint.

All matters relating to the moral and ethical conduct, dignity, integrity and reputation of the Sanggunian and its members in connection with the performance of their official duty and their own personal conduct as public officials individually or collectively; Provided, That any complaint filed against any member of the Sanggunian must be made in writing and under oath. Such complaint shall be referred to the committee which shall act on it upon a vote of two-thirds of its members by recommending to the Sanggunian the censure, reprimand, suspension or expulsion, or any other appropriate disciplinary action as it may deem just and reasonable and in accordance with existing laws

It shall further hear and investigate administrative cases against elected barangay officials. However, on a case-to-case basis and upon majority vote of all the members, the City Council (Sangguniang Panlungsod) may assume jurisdiction on a particular administrative case of elected barangay officials. It shall likewise initiate and/or undertake measures that would protect and promote the basic rights of every citizen, based on truth, justice, and law, and further initiate studies, researches, inquiries and investigations of the same.

9) Committee on Finance, Budget and Appropriations - It shall study investigate and report on all matters and measures, including but not limited to proposed ordinances or resolutions directing the payment of money or creating a liability against the City Government.

10) Committee on Games and Amusement - All matters relating to games and amusement, such as but not limited to lotteries, jai-alai, horse racing, dog-racing, wrestling, cockfights/derbies.

11) Committee on Health and Health Insurance - It shall study, investigate and report on all matters concerning health and social health insurance, measures seeking the prevention and cure of diseases, and the implementation of a universal social health insurance for indigents as well as the maintenance, operation or expansion of the City Health Department, City Hospital, all Health Centers throughout the City, and the City Health Insurance Office.

12) Committee on Labor & Employment - It shall also study, investigate and report and on all matters involving the rights and duties of workers in their relations among themselves, their employers and with the public, and/or measures intended to uplift or maintain the dignity of labor; mediation, conciliation and arbitration of labor disputes, wages and hours of labor, women and child labor, statistics and labor standards. 

13) Committee on Laws and Rules - It shall prepare the rules of the body, study, device, and report better methods for the smooth conduct of the body’s   proceedings.   The committee shall also prepare the agenda for the session of the body and furnish the members thereof with a copy of the same to be delivered to their usual place of residence at least twenty-four (24) hours before the session during which said agenda is set for discussion. Furthermore, the committee shall study, investigate and report on the legal aspect of all matters and measures, including proposed motions, resolutions, ordinances, or the revision or amendment of any existing ordinance and all legislation, recommended for enactment.

14) Committee on Planning, Research & Innovation and People’s Organization Accreditation – It shall study, investigate and report on all matters and measures pertaining to city planning, zoning, land classification, land use and management, urban community development, development and advancement of science and technology; scientific and technological research. It shall review and recommend actions on the Annual Investment Program (AIP), Comprehensive Land Use Plan (CLUP), City Development Plan (CDP), Executive Legislative Agenda (ELA) and other short- and medium-term plans of the City.

It shall likewise take cognizance of all matters or measures pertaining to strategic planning, research and innovation, and/or science-based technology relevant to the promotion of sustainable economic growth and social development. All matters relating to the appointments of City Government employees from Heads of Departments or Chiefs of Offices, to the rank and file personnel as well as the structures, organizational set up functions and supervision, staffing pattern and human resource development policies of all offices and departments of the City Government including their reorganizations.

It shall also evaluate the application for accreditation of civil society organizations and people’s organizations for purposes of membership in the local special bodies.

15) Committee on Public Order & Safety – It shall study, investigate and report on all matters and measures, including proposed ordinances or resolutions dealing on police matters, including but not limited to measures concerning the prevention of destruction or injury to limb, life and property and all other matters relating to the peace and order of the City, and those concerning fire and its prevention, jail matters such as but not limited to the welfare of inmates and all matters pertaining to Barangay Police. It shall likewise study and recommend measures designed to curb all forms of vandalism, vagrancy and drug abuse.

 

16) Committee on Public Utilities, Energy and Transportation - It shall study, investigate and report on all matters and measures including but not limited to proposed ordinances or resolutions, and to which shall be referred all proposed legislation, messages, petitions, memorials, and other matters relating to the exploration, development, exploitation or conservation of energy and water; public utilities engaged in power and water generation, transmission, distribution and supply; rural electrification and street lighting; land, sea and air transportation and all public utilities connected therewith; transport system; road safety; traffic management; seaports; airports; postal; telegraph; radio; television; telephone; and other communication services.

All matters relating to telephone systems and services, advanced communication technologies (e.g. wireless communication systems, cable modern, etc.); IT infrastructure development, IT human resources development, IT education, research, development and advancement and other IT matters and services.

17) Committee on Public Works - It shall study, investigate and report to the body all matters concerning public works and construction, or maintenance of roads, streets, canals, drainage systems, waterworks, buildings, equipment depot and other matters of similar nature. 

18) Committee on Social Services - It shall study, investigate and report on all matters and measures having to do with social welfare administration and/or those pertaining to public service, and/or directly and principally relating to the social development and welfare of persons with disabilities or special needs including social services and interventions that develop and enhance the quality of individual and community life.

19) Committee on Senior Citizens - It shall study, investigate and report on all matters relating to the proper care and welfare of the senior citizens, the aged, and the disadvantaged persons. Formulate measures, policies and programs for their benefit.

20) Committee on Subdivision and Landed Estate – It shall study, investigate and report on all matters and measures pertaining to city planning, subdivision, layout of roads, streets, canals, electric and telephone lines, and related matters and measures pertaining to the acquisition or expropriation of landed estate for the establishment of housing projects for qualified and deserving poor landless residents and all measures for the promotion and development of human settlement.

21) Committee on Sister City Relation - It shall study, investigate and report on all matters involving the promotion of the sisterhood or sister city relation program for the purpose of fostering national or international understanding and friendship through exchanges of people, artifacts and ideas with residents/citizens of local and foreign cities and to develop an increased appreciation of cultural diversity for better understanding of other cities’ culture.

22) Committee on Sports and Youth Development – It shall study, investigate and report on all matters and measures affecting the development and training of the youths for responsible leadership and civic consciousness, and promotion of various youth and sports program of the city.

23) Committee on Tourism - It shall study, investigate and report on all matters involving the promotion of the arts and cultural affairs; the enhancement, promotion and development of tourism and beautification; initiate, conduct and promote studies and/or researches pertinent to facts and events affecting legislation as well as look for possible avenues and sources for the establishment of a city government building that would house important works of art, historical and scientific objects depicting the life, culture and tradition of the people of Cagayan de Oro City. It may, in consultation with the Philippines Historical Commission, change the name of the city and barangays, upon the recommendation of the barangay concerned, city roads, avenues, boulevards, thoroughfares, and bridges, public elementary, secondary and vocational or technical schools, community colleges and non-chartered colleges, city hospitals, health centers and other health facilities and other historical landmarks, public places, or building owned by the City Government.

24) Committee on Trade and Commerce - It shall study, investigate and report on all matters relating to trade, internal commerce and industry in general, protection of such commerce and industry against unlawful restraint and monopolies, all matters relating to economic planning and programming.

25) Committee on Urban & Rural Poor and Housing Development – It shall study, investigate and report on all matters pertaining to the condition and status of the poor and underprivileged and promote their conditions in resettlement areas by making available to them decent housing at affordable cost, basic services and employment opportunities.

26) Committee on Ways & Means - It   shall study investigate and report on all matters and measures, including but not limited to the levy and collection of taxes, fees, charges for services rendered by the City or any of its department, branch or office; assessment or appraisal of real properties; donations, loans and other sources and forms of revenue.

27) Committee on Women and Family Relations – It shall study, investigate and report on all matters relating to the protection of women and family; measures to protect working women by providing safe and healthful working conditions, taking into account their maternal functions, and such facilities and opportunities that will enhance their welfare and potentials; measures to protect the rights of spouses and children, including assistance for proper care and nutrition, and special protection from all forms of neglect, abuse, cruelty, exploitation and other conditions prejudicial to their development; measures to protect the rights of families or family associations to participate in the planning and implementation of policies and programs that affect them.

28) Committee on Arbitration of Barangay Boundary Disputes – It shall act on complaints regarding disputes on boundaries among the barangays in the City as well as on all matters involving boundary disputes with adjacent municipality/ies and/or province/s.

29) Committee on Energy - It shall study, investigate and report on all matters and measures, including but not limited to proposed ordinances or resolutions, and to which shall be referred all proposed legislation, messages, petitions, memorials, and other matters relating to gas, electric, coal production, distribution, and utilization; energy policy; energy regulation and conservation; energy research and development; hydroelectric power; oil and gas production and distribution; and solar energy systems. Such committee shall also study and review, on a comprehensive basis matters relating to energy and resources development, and report thereon from time to time.

30) Committee on Fisheries and Aquatic Resources - It shall study, investigate and report on all matters or proposed ordinances or resolutions related to fisheries and aquatic resource preservation and development of fishing grounds; and construction of fish ponds, corrals, oyster beds, and regulatory measures therefor.

32) Committee on Cultural Communities - All matters directly and principally relating to cultural communities’ and Indigenous Peoples’ (IPs) welfare and development and their community areas.  Formulate policies, plans and programs which will promote and protect the rights and well-being of Indigenous Peoples (IPs) and their ancestral domain, the preservation of their heritage; livelihood opportunities and programs for their growth and development.

SECTION 14. COMMITTEE COMPOSITION. – A committee shall be composed of a Chairperson, Vice-Chairperson and three members who shall be elected by majority vote of the body. The City Vice-Mayor and Presiding Officer may chair a committee.

SECTION 15. EX-OFFICIO MEMBERS.The City-Vice Mayor and Majority Floor Leader shall be Ex-Officio Members of all standing committees.

 

SECTION 16. SECTORAL REPRESENTATIVES. – The Sectoral Representatives/Ex-Officio members of the City Council, namely: President of the Liga ng mga Barangay and President of the City SK Federation, maybe elected or assigned to become chairperson, vice chairperson or member/s of the City Council standing committees, special committees or ad hoc committees, as the case maybe, aside from those committees or sectors they represent as provided for by law.

 

SECTION 17. DUTIES OF COMMITTEES. – Permanent and special committees may hold meetings and/or public hearing to deliberate and report on matters referred to them or initiated by them whenever necessary.

 

SECTION 18. QUORUM.A majority of the regular members of the Committee shall constitute a quorum. However, for the prompt disposal of the committee’s work for the ascertainment of facts or of law, the committee may proceed with the meeting even with one member thereof present; Provided, That the proceedings shall be duly recorded.

 

The Committee may, however, act without conducting a formal meeting on any matter referred to it, which does not necessitate the ascertainment of facts or of law; Provided, That the committee report shall bear the signature of at least three members thereof. A committee member, unless he/she has entered his/her objections to the committee report or, in lieu thereof, has filed with the Secretary to the Sangguniang Panlungsod his/her dissenting vote in writing before the report is submitted to the Body in open session, shall be presumed to have concurred with the report and shall thus be precluded from opposing it in the floor.

 

The Committee may invite any person, official or employee of the City Government or that of the National Government based in the City of Cagayan de Oro to appear before it in any of the committee meetings to shed light on matters which may be necessary in aid of legislation, and said person, official or employee should be informed of the subject matter before his/her appearance.

SECTION 19.  PROCEDURE OF MEETINGS.

 

(a) The chairman shall, from time to time, convene the committee. If he is absent, fails, neglects, or refuses to convene the committee, it may meet upon written petition of the majority of its members.

(b) Any person may appear at a committee meeting and present his view on the matter before the committee, at such reasonable time as, upon request, the committee may schedule.

(c) No person shall be present during the final deliberations of the committee, except the members and such employees of the legislative body as may be necessary to facilitate the performance of its legislative functions.

 

(d) All questions before the committee shall be put to a vote, unless agreed otherwise by the members thereof.

 

(e) After final deliberations and voting, the committee shall prepare for submission to the legislative body, a written report to be signed by the chairman and members. Any dissenting member shall submit in writing the reasons for his dissent. If, for urgent reason, a verbal report is submitted or reported by the chairman before the body, it shall be considered as the report of the committee, unless objected to by the majority of the members of the committee.

SECTION 20. AD HOC COMMITTEE. - The legislative body may, from time to time create special ad hoc committees for specific purposes, which shall automatically cease to exist upon the receipt by the former the latter’s final report.

 

SECTION 21. SPECIAL COMMITTEE.  - The Sanggunian may organize and/or create special committee as it may deem necessary. The Sanggunian members may, upon majority vote of all members, elect the members/officers or may authorize the presiding officer to choose from the Sanggunian members the officers and members.

 

SECTION 22. JOINT COMMITTEE MEETING. - When a measure covers subject matters falling within the jurisdiction of more than one committee, said measure shall be referred jointly to the committees concerned, which shall also jointly report them in writing, before they are considered for deliberation by the body thru the motion of the majority floor leader.

 

SECTION 23. VACANCY. - Whenever a vacancy occurs or is declared to exist in any of the committees, the same shall be filled by election of the majority vote of all Sanggunian members.

 

SECTION 24. COMMITTEE MEETING OR HEARING. - The committee shall determine the frequency of its meeting or hearings; Provided, That it meet at least once a month or as often as necessary.

RULE X

REORGANIZATION OF STANDING COMMITTEES

SECTION 25. REQUIREMENT. – No Proposed Resolution calling for the reorganization of the Standing Committees of the body shall be calendared for ordinary or special session unless the proposed measure is signed by majority of the members of the Sangguniang Panlungsod, has been duly filed with the City Secretary and copies thereof distributed to the members 48 hours prior to the scheduled session called for the purpose.

RULE XI

REORGANIZATION OF STANDING COMMITTEES

SECTION 26.  SCHEDULE, VENUE OF SESSION:

(a) The City Council (Sangguniang Panlungsod) shall meet in a Regular Session at 2:30 PM of every Monday of each week.

 

(b) The City Council shall hold a Special Session on a date and time fixed by the City Mayor in his/her call for Special Session or by the majority of the members of the body when public interest so demands. In the case of special sessions, a written notice to the members of the body shall be served personally at the members’ usual place of residence at least twenty-four (24) hours before the session is held. Unless otherwise concurred in by two-thirds (2/3) vote of the members present, there being a quorum, no other matters may be considered at a special session except those stated in the notice.

In exigency of the service and to move the day and/or time of the Regular Session to another day of the week or to a later time of the day and the giving of written notice to all members cannot be complied within the 48-hour rule in the delivery of such notices, the City Vice Mayor upon consultation with the majority members, shall inform all the members of the change of time through the best available modern communication technology like telephone, mobile phone and/or SMS (text messaging), internet (email) and fax machine, among others, and get the conformity of the majority members of such change.

 

(c) Unless otherwise fixed, the regular session shall be held at its Session Hall.

(d) The City Council (Sangguniang Panlungsod) may hold its Regular Session outside of the regular venue as maybe agreed upon by majority members of the body, to hear directly the problems, issues, plans and proposals of barangay officials concerned.  Except for urgent bills, no other items shall be calendared for deliberation during such session.

In such session, the Punong Barangay/s of the concerned barangay or cluster of barangays shall be given time to report on any problem or issues of the barangay to the City Council (Sangguniang Panlungsod), which shall directly refer the same, without deliberation, to concerned standing committee of the body. The committee shall immediately act thereon and report to the City Council (Sangguniang Panlungsod) its findings and recommendations on the matter.

 

SECTION 27. NATURE OF SESSION. Sanggunian session or meetings of any committee shall be open to the public, unless a closed session is decided or ordered by the affirmative vote of the majority of all members present, there being quorum, for reasons of security, decency or morality, or for other reasons affecting the dignity of the Sanggunian or any of its members, or when confidential matters are being considered.

On motion to hold a closed session, duly approved, the presiding Officer shall direct the Session Hall cleared and all doors closed. Only the secretary and such other persons especially authorized by the Sanggunian to be present shall be admitted.

In case, and for the duration, of a public health emergency or epidemic/pandemic, the Sanggunian session, upon majority consent of all members, may be held through web or video conferencing; Provided, that such session shall be aired through live audio and video web streaming; Provided further, that all members shall be duly notified through call or SMS at least two (2) hours before such session.

 

SECTION 28. EXECUTIVE SESSION. Outside the regular or special session herein provided, the City Council (Sangguniang Panlungsod) may also meet in an executive session on any day, time and place as specified in the call issued by the City Mayor or the Vice Mayor.

SECTION 29. REGULAR SESSION DAY FALLS ON HOLIDAY. – In case the Regular Session Day falls on a public holiday, the preceding or next working day shall be the regular session day, unless the latter is also a public holiday, in which case, the regular session shall be held on the next working day immediately following.

SECTION 30. ATTIRE DURING SESSION. – All members shall wear during sessions barong or coat-and-tie for male, and equivalent formal attire for lady members.

SECTION 31. ATTENDANCE IN SESSION. - Every member of the Sanggunian shall be present in all sessions, unless expressly excluded by it or necessarily prevented from doing so by sickness or other unavoidable circumstances duly reported to the Sanggunian through the Secretary.

SECTION 32. SUSPENSION AND ADJOURNMENT. - Sessions shall not be suspended or adjourned except upon the direction of the majority of all members of the Sanggunian, but the Presiding Officer may in his discretion, declare a recess of short intervals.

RULE XII

QUORUM

SECTION 33. QUORUM

 

(a) A majority of all members of the City Council who have been elected and qualified (Art. 106 IRR – RA 7160), which shall be one-half plus one (1/2+1), shall constitute a quorum to transact official business. Should a question of quorum be raised during a session, the presiding officer shall immediately proceed to call the roll of the members and thereafter announce the results.

(b) Where there is no quorum, the Presiding Officer may declare a recess until such time a quorum is constituted, or a majority of the members present may adjourn from day to day and may compel the immediate attendance of any member absent without justifiable cause by designating a member of the Sanggunian, to be assisted by a member/s of the City Police Office to arrest the absent member/s and present him/her at the session.

(c) If there is still no quorum despite the enforcement of the immediately preceding subsection, no business shall be transacted. The Presiding Officer, upon proper motion duly approved by the members present, shall then declare the session adjourned for lack of quorum.

RULE XIII

CALENDAR OF ORDINARY BUSINESS AND

APPROVAL ON FIRST AND SECOND READING

SECTION 34. FORMAT OF AGENDA ITEMS. – All items in the agenda for ordinary business prepared by the Committee on Laws & Rules shall be expressed and formalized in Proposed Motions, Proposed Resolutions and Proposed Ordinances.

The first reading of the proposed measure shall consist in the reading of the number and title thereof. The full text of the proposed measure (regulatory and penal in character) shall be appended to the agenda with its proper markings, copies of which agenda being furnished to every member of the City Council (Sangguniang Panlungsod) at least 48 hours before the Regular Session.

 

SECTION 35. DISCUSSION OF MEASURE. – After the reading of the number and title of any measure in the calendar of business, the City Council (Sangguniang Panlungsod) may amend, modify or disapprove the same after discussion of the measure, or refer it to the proper committee if the body is not ready to discuss the same, otherwise, discussion shall ensue.

 

SECTION 36. PERIOD OF AMENDMENT. – After the close of the debate, the City Council (Sangguniang Panlungsod) shall proceed to the consideration of any amendment as may be proposed by the sponsoring committee thereof or by any member of the Council. Discussion of the proposed amendment shall follow.

SECTION 37. APPORVAL OF PROPOSED MOTIONS, PROPOSED RESOLUTIONS & PROPOSED ORDINANCES ON FIRST READING. – After the period of discussion and/or amendment of the proposed measure, the same shall be put to a vote. No member for or against the measure or those who shall abstain from voting thereon shall be allowed to discuss or explain his/her stand on the proposed measure.

 

If the proposed measure is passed as presented and/or as amended, it shall be approved on first reading.  The second and final reading thereof maybe expressly dispensed with during the first reading through a motion duly seconded.

 

SECTION 38. TRANSMITTAL OF APPROVED ORDINANCE TO THE CITY MAYOR. – After an ordinance is passed on second and final reading or if the second reading thereof is expressly dispensed with during the first reading, it shall be forwarded to the Mayor for approval within ten (10) days after their enactment or adoption.

RULE XIV

VOTES REQUIRED TO PASS ANY MOTION, RESOLUTION OR ORDINANCE

SECTION 39. TWO-THIRDS VOTE. – A concurrence of at least two-thirds (2/3) of all the members of the City Council (Sangguniang Panlungsod) shall be required to grant tax exemptions, incentives or relief to entities engaged in community growth-inducing industries and the same number of voters is required to override a veto of the City Mayor on any ordinance passed by the City Council (Sangguniang Panlungsod).

 

SECTION 40. MAJORITY. – A majority vote of all members of the City Council (Sangguniang Panlungsod) shall be required in granting a franchise to any person, partnership, corporation, or cooperative to do business within the City, establish, construct, operate and maintain ferries, wharves, markets or slaughterhouse, or undertake such other activities within the City; levying taxes, fees and charges; authorizing the City Mayor to negotiate and contract loans and other forms of indebtedness; authorizing the floating of bonds or other instruments of indebtedness, for the purpose of raising funds to finance development projects; and authorizing the city mayor to lease to private properties such public buildings held in a proprietary capacity, subject to existing laws, rules and regulations. However, all other measures shall be passed by a simple plurality.

RULE XV

MINUTES

SECTION 41. MINUTES OF HE PROCEEDINGS. – The City Council (Sangguniang Panlungsod) shall keep minutes of its proceedings, which shall be succinct and exact account of what has been approved in every session.

 

SECTION 42. CONTENTS. – The minutes shall contain the following:

 

(a) The members present

(b) The members absent

(c) The members on official business outside their official stations

(d) The date and time convened and adjourned

(e) The motions, resolutions and ordinances approved and disapproved; movant of, and those who seconded on, each motion, resolution and ordinance approved.

(f) The full text of approved Penal and Regulatory Ordinances; measures with substantial corrections; and those approved without formal drafts submitted except Resolutions of congratulation, commendation, condolences and the like.

 

SECTION 43. READING. - The reading of the Minutes of the previous session shall not be interrupted or suspended except by unanimous consent of the body.

 

SECTION 44. READING DISPENSED. - The reading of the Minutes of the previous session maybe dispensed with by the majority consent of the body without prejudice to correction of any part or portion thereof before final approval upon a motion to approve the same.

RULE XVI

SUSPENSION OF THE RULES

SECTION 45. SUSPENSION. – The rules of this body maybe suspended to allow non-members thereof to address it in session or whenever it is necessary and practical.

 

SECTION 46. VOTES REQUIRED FOR RULES SUSPENSION. – A motion to suspend the rules shall require majority vote of all the members present.

RULE XVII

THE CITY COUNCIL (SANGGUNIANG PANLUNGSOD) JOURNAL

SECTION 47. NATURE.­ – The City Council (Sangguniang Panlungsod) shall keep and preserve a journal of its session, which shall reflect in detail everything that has been said, done and read in the session in such a manner that it shall express faithfully everything that takes place therein.

RULE XVIII

THE RIGHT OF THE PRESIDING OFFICER

SECTION 48. BREAKING. – The Presiding Officer shall not vote on any measure in the agenda except to break a tie.

RULE XIX

REQUISITES OF PROPOSED RESOLUTION AND ORDINANCE

FILED BY INDIVIDUAL MEMBER OF THE CITY COUNCIL

SECTION 49. ORDINANCES AND RESOLUTIONS. - Legislative action of a general and permanent character shall be enacted in the form of ordinances, while those of temporary character shall be passed in the form of resolution.

Matters relating to proprietary functions and private concerns shall also be acted upon by resolutions

 

SECTION 50. REQUIREMENT. – Any proposed resolution or ordinance filed with the City Secretary by individual member of the body must be signed by one or more members. If its author is the Committee called to study it and make recommendation relative thereto, the measure shall be signed as authors by the Chairman or the Acting Chairman of the said Committee and the members present during deliberation thereof.

RULE XX

PREAMBLE OF PROPOSED RESOLUTIONS AND ORDINANCES

SECTION 51. PREAMBLE. – All proposed resolutions and ordinances shall contain a preamble expressed in and introduced by “Whereases” or “Explanatory Notes”, respectively.

RULE XXI

FILING OF PROPOSED RESOLUTION OR ORDINANCE AND TREATMENT OF REQUEST, PETITIONS AND OTHER COMMUNICATION FILED WITH THE BODY

SECTION 52. MANNER OF FILING. – A proposed resolution or ordinance may be filed by the author/s with the City Secretary who upon receipt thereof shall assign to it a number for purposes of record and identification and who shall direct its immediate reference to appropriate committee of the body. The City Secretary shall also direct the immediate reference of requests, petitions and other communications filed with the body to appropriate committees.

SECTION 53. URGENT MATTERS. – The following proposed legislative measures shall be included in the agenda of the Regular Session without being referred to appropriate committees:

 

(a) Those certified to as urgent by the City Mayor; and

(b) Those filed by members of the City Council (Sangguniang Panlungsod) as an offshoot of their Special Report and certified to as urgent by either two of the Presiding Officer and/or the Presiding Officer Protempore and/or Chair of the Committee on Laws and Rules.

RULE XXII

MANNER OF HAVING A FLOOR

SECTION 54. RAISING HAND. – Whenever a member of the City Council (Sangguniang Panlungsod) wishes to take the floor, he/she shall raise his/her right hand and request the Presiding Officer for recognition, which consent and recognition shall be necessary before taking the floor.

           

If two or more members wish to take the floor, the Presiding Officer shall recognize the one who first raises his/her right hand to seek recognition.

 

SECTION 55. PROHIBITION. – No member of the City Council (Sangguniang Panlungsod) shall interrupt or interpolate the member who has the floor without the latter’s consent.

 

RULE XXIII

MOTIONS AND THEIR PRECEDENCE

SECTION 56. MOTION. –

 

(a) Every motion made to the City Council (Sangguniang Panlungsod) shall be entered on the records of the City Council with the name of the member making it, unless withdrawn on the same session.

 

(b) A motion must be seconded before it shall be accepted by the Presiding Officer except for motions which do not require a second, viz:

 

(i) To raise a question of privilege;

(ii) To raise a point of order;

(iii) To raise a point of information;

(iv) To raise a point of parliamentary inquiry;

(v) To call for orders of the day;

(vi) To withdraw a motion;

(vii) To object to the consideration of a question;

(viii) To request for the division of the question or house.

 

(c) When a motion has been made, the Presiding Officer shall state it to the Body or, if it be in writing shall cause it to be read aloud by the Secretary to the Sanggunian before being debated.

 

SECTION 57. PRECEDENCE OF MOTION. – While a motion to approve any item in the agenda, duly seconded, is being discussed, no other motion shall be entertained except the following in the order in which they appear below:

(a) Privileged Motion

(b) Incidental Motion

(c) Subsidiary Motion

 

RULE XXIV

MOTION FOR RECONSIDERATION OF ACTION

TAKEN IN ANY ITEM OF THE AGENDA

SECTION 58. REQUIREMENT. – When a motion to approve any item in the agenda has been adopted or lost, only a member who voted affirmatively for the passage of the same shall be entitled to present a motion for reconsideration in the same session. Any member who abstained from voting shall absolutely have no right to ask for reconsideration.

 

RULE XXV

QUESTIONING CHAIR’S RULING

SECTION 59. MANNER. ­– A member who questions the ruling of the chair shall seek floor recognition and not engage in protracted debate with the chair but appeal the ruling directly to the body in a motion duly presented and seconded. Such motion shall be resolved without debate. If the body resolves the motion in the negative, or if the voting results to a tie, the decision of the chair shall be deemed to have been sustained.

 

RULE XXVI

POINT OF ORDER

SECTION 60. MANNER. – All points of order may be raised at any time during session by any member of the body, which shall be resolved by the chair whose decision can be appealed to the body.

 

It shall be discretionary on the part of the chair to submit to the body for resolution any point of order raised.

RULE XXVII

VOTING

SECTION 61. TYPES OF VOTING. – Voting on any motion shall be made in any of the following methods or procedures:

 

(a) by raising hand

(b) by voice

(c) by roll call

(d) by ballot

(e) division of the house

RULE XXVIII

QUESTION HOUR

SECTION 62. RESOURCE PERSON. – The City Council (Sangguniang Panlungsod) may invite any person to appear before it in any session to shed light on any issue, which may be necessary in aid of legislation. Said official or personnel shall be informed of the subject matter two (2) days before his/her appearance.

RULE XXIX

LANGUAGE REQUIREMENT

SECTION 63. OFFICIAL LANGUAGE. – The national language and English shall be used in the proceedings of the City Council (Sangguniang Panlungsod). However, the speaker, at his/her option, during the privilege time may choose any language or dialect spoken of and understood by the majority of the residents of the City of Cagayan de Oro.

RULE XXX

ORDER OF BUSINESS

 

SECTION 64. SEQUENCE. – The Order of Business of the body shall be as follows:

 

(a) Call to order by the Presiding Officer

(b) Invocation by any member of the body

(c) Singing of the National Anthem

(d) Singing of the Cagayan de Oro March

(e) Roll call and determination of quorum

(f) Reading, correction if any, and approval of the minutes of the previous session

(g) Special Report by any member (Privilege Time)

(h) Agenda

(i) Adjournment

RULE XXXI

SPECIAL REPORT TIME (PRIVILEGE TIME)

 

SECTION 65. PRIVILEGE TIME. ­– Special Report shall consist of one (1) hour during which any member may address the body on any matter of public interest.

SECTION 66. RULES ON SPECIAL REPORT:

(a) Only one topic or subject matter shall be allowed per special reporter.  However, if there are no other members of the Body who would like to make a special report and the one-hour privilege time has not yet expired, he/she may seek recognition and approval of the Chair to render another special report covering a different subject matter.  In no case shall there be more than three Special Reporter in one Session unless allowed by the Presiding Officer.

(b) Any member of the City Council (Sangguniang Panlungsod) who would like to avail of the privilege time shall signify his/her intention by stating the subject matter of his/her special report to the Majority Floor Leader who shall recommend to the Presiding Officer for his/her recognition. When two or more members want to render special report, the Majority Floor Leader shall chronologically recommend to the Presiding Officer for recognition starting with the first to signify his/her intention to render special report.

At this juncture, the Chair shall request the member who seeks recognition from the Chair to state what question of the privilege he/she will bring to the attention of the City Council (Sangguniang Panlungsod) and if such question involves public nature or interest, the Chair, moto propio, shall recognize him/her.

The member so recognized to address the body during the privilege time shall continue to rise during the privilege time allotted to him/her and shall speak for not more than ten (10) minutes.

(c) The member concerned, shall in the course of his/her privilege speech, limit or confine his/her piece to his/her stated subject and shall never deviate therefrom nor resort to name–calling, mudslinging, innuendoes and other unparliamentary or derogatory remarks against the dignity and/or reputation of any public official or private citizen or of any entity or institution. He/she shall, at all time, maintains proper decorum befitting the dignity, integrity, and reputation of a member of the Body.

(d) If, at this juncture, the speaker deviates from his/her stated subject or resort to unparliamentary or derogatory remarks, the Presiding Officer shall interrupt him/her and warn him/her not to deviate therefrom or resort to such unparliamentary or derogatory remarks. If said speaker continues to ignore the warnings, the Chair shall direct the speaker to take his/her seat, and to order the striking out from records of such remarks.

(e) If the ten minutes allotted to him/her is not enough, he/she shall, immediately thereafter, request the Chair for extension of not more than five (5) minutes.

(f) Likewise, at this juncture, the Chair shall refer the request to the body for approval without debate. If approved, the Chair shall advise the speaker to continue his/her privilege speech.

(g) While the speaker is delivering his/her privilege speech, no other member shall interrupt or interpolate said speaker until he/she has finished his/her speech, except, on question of point of order.

(h) After the privilege speech of the speaker, any other member or members of the City Council (Sangguniang Panlungsod) may propound clarificatory questions to the speaker/reporter but in no case shall such interpellation exceed a period of five (5) minutes per member and shall be allowed to interpolate only twice per subject matter.

(i) If that member feels that there is a need to give a rejoinder or to amplify the subject matter, he/she may do so if the Chair so recognizes him/her; Provided, That the one-hour Privilege Time is not yet exhausted.

(j) If the privilege speech of any member calls for, before closing his/her speech, may without debate, notify the body of his/her intention to have the matter included in the agenda, or any member other than the speaker may likewise notify the body for the inclusion of the same in the agenda.

(k) Debate on the merits or demerits of the measures sought to be included in the agenda shall be made only during the consideration of the same in the agenda.

(l) If, after the period of interpellation, the one–hour privilege time has not yet expired, any other member may seek recognition to avail of the remaining unused privilege time, with the right to continue in the next regular session, if he/she has not finished his/her speech within the ten (10) minutes time allotted to each member under these rules.

m) Preference in reservation in the next regular session shall be in following order:

i.     The member who has notified the Majority Floor Leader of his/her intention to deliver rejoinder or remarks on the matter taken up by the speaker or speakers in the previous session.

ii.    The member who availed of the remaining unused privilege time and was not able to finish his/her speech arising from the expiration of the one-hour privilege time.

iii.   The member who has not yet availed of the privilege time during the last two Regular Sessions.

 

SECTION 67. DISPENSATION OF THE SPECIAL REPORT TIME. – In the event there is an Appearance item/portion in the agenda of the Regular Session as approved by the Committee on Laws & Rules, the Special Report Time shall be automatically dispensed with to accommodate and give ample time to the invited guest(s)/resource person(s) to address the august body and answer queries from the members thereof. However, if time permits, any member may seek permission from the Presiding Officer to give his/her Special Report and if allowed by the Presiding Officer shall render his/her Special Report but in no case such report exceeds the allotted period for Special Report Time as provided herein.

RULE XXXII

BOOKS AND RECORDS OF THE CITY SECRETARY

 

SECTION 68. BOOKS AND RECORDS. – The City Secretary shall keep the following:

(a) The minutes where he/she shall enter all approved and vetoed actions, resolutions and ordinances.

(b) The journal where he/she shall enter the City Council’s (Sangguniang Panlungsod) entire proceedings.

(c) The register where each member of the City Council (Sangguniang Panlungsod) shall sign and register his/her name when attending regular or special session.

(d) Books and records required by the Charter, other laws or those required by the City Council (Sangguniang Panlungsod).

RULE XXXIII

UNPARLIAMENTARY ACTS AND UTTERANCES

 

SECTION 69. UNPARLIAMENTARY ACTS OR UTTERANCES. – Acts or utterances that are derogatory to the body or any of its members shall be deemed unparliamentary.

SECTION 70. PROHIBITION. – No member of the City Council (Sangguniang Panlungsod) under any circumstances during the consideration of any item in the agenda shall use offensive or improper language against another member of the body or the body itself.

When a member of the body, by word or deed, violates any rule, the Chairman shall call him/her to order, and the member concerned shall immediately desist from continuing his/her unparliamentary words or deeds, or relinquish the floor if he/she happens to have the floor.

           

SECTION 71. STRIKING OUT FROM RECORDS. – When a member is called to order by the Presiding Officer for employing improper language during the debate or consideration of any item in the agenda, any member may move to strike out from the records the words or utterances objected to, which shall be resolved without debate. This shall likewise apply to the unparliamentary language of the Presiding Officer.

SECTION 72. NON-MEMBER, PROHIBITION – When non-member of the body authorized to address it employs improper word derogatory to the body or its member/s on the course of his/her address or speech, the Presiding Officer shall call his/her attention thereto, and if necessary, deny him/her the floor or expel him/her from the Session Hall.

RULE XXXIV

DISCIPLINARY ACTION

 

SECTION 73. VOTES REQUIRED –

 

(A) Any member who commits any of the following disorderly acts or behavior during session shall, by two–thirds (2/3) vote of the member present, be reprimanded by the Chair or for repeated commission of the same during the same session, be excluded from the session:

 

(a) Refusal after repeated warnings made by the Presiding Officer to desist from employing offensive or improper language or unparliamentary or derogatory remarks against any member of the body or the body itself.

(b) Refusal to abide by the ruling of the Presiding Officer or of the body on question of point of order and other question involving proper decorum.

(c) Taking the floor without having been first recognized by the Chair and refusing to give up the floor after the Presiding Officer has directed him/her to this effect.

(B) By two-thirds (2/3) vote of all its members, the body may censure, reprimand, or suspend any member for incurring absences without justifiable cause for four (4) consecutive sessions.

 

(C) By two-thirds (2/3) vote of all its members, the body may likewise censure, reprimand or suspend a member for conduct unbecoming of a City Councilor or for any utterance/s or act/s inimical to the good name, reputation, dignity and integrity of the of the City Council (Sangguniang Panlungsod) or any of its members, whether committed inside or outside its Session Hall.

 

(D) The Presiding Officer may exclude from the Session or expel from the Session Hall any member of the Body or any person for refusal to abide by the ruling of the Presiding Officer, or for disorderly or scandalous conduct, unruly behavior, gross misbehavior including disrespectfulness, violence, drunkenness or for disrupting official proceedings of the City Council (Sangguniang Panlungsod) during session.

RULE XXXV

PROHIBITED ACTS AND DISCOURTESY DURING SESSION

 

SECTION 74. IN COMING LATE. – While the body is in session, a member who comes in late shall seek recognition from the chair by raising his/her hand for the purpose of recording his/her presence.

SECTION 75. LEAVING THE SESSION. – Likewise, while the body is in session, a member who shall leave the Session Hall with the intention of not returning back for that session shall seek the permission of the chair.

SECTION 76. PROHIBITION. – While a member has the floor and/or discussing any item of the agenda under consideration, no two or more members shall talk or converse with each other as to disrupt the attention of the member on the floor on in any way show disrespect to the speaker.

Any member who would like to confer with another member/s of the body during session, shall request the chair to declare recess or suspend the session for a few minutes, who shall grant the same if the request is reasonable and the matter to be subject of the huddle or conference is related to the item in the agenda under consideration, in which case the chair before granting the request shall inquire from the requesting member of the reason for a huddle or conference.

SECTION 77. -DEADLY WEAPONS. – No person shall be allowed to bring inside the Session Hall any deadly weapon, such as guns, bladed weapons, etc. except for the designated Sergeant-at-Arms. 

Persons legally authorized to carry firearms by nature of their job shall deposit the same at the Office of the City Council Secretary before he/she shall be allowed to enter the Session Hall.

AMENDMENT

 

SECTION 78. REQUIREMENT. – These rules or any part hereof may be amended by at least two-thirds (2/3) vote of all the members of the City Council (Sangguniang Panlungsod).

SUPPLEMENTAL RULES

 

SECTION 79. SUPPLEMENTAL RULES – The Parliamentary Rules of Procedures by Orendain and the Robert Rules of Order shall be suppletory to these rules insofar as they are not inconsistent herewith.

In case of conflict, however, between the provisions of this House Rules and the Local Government Code, the latter shall prevail.

Resolved further, to forward copies of this Resolution to all the members of the City Council (Sangguniang Panlungsod) for their information and guidance.
